Converting a Mobile Home to Real Property in Virginia

Virginia law lets the owner of a manufactured home affixed to their own land surrender the DMV title and have the home treated as part of the real estate. This is the single biggest fork in the road for Virginia mobile home sellers.

What the statute allows

Va. Code § 46.2-653.1 provides a mechanism for the owner of a manufactured home that is permanently affixed to land they own to surrender the certificate of title to the DMV so that the home is thereafter treated as real property.

The DMV affidavit used in this process is Form VSA 35. The resulting documentation is recorded in the land records of the circuit court in the locality where the home is located.

Why owners do it

Financing. Conventional mortgage products generally require the home to be real property on a permanent foundation.

Simplicity. One deed instead of a deed plus a DMV title, and one real estate tax bill instead of separate real estate and personal property bills.

Resale. A converted home on a permanent foundation appeals to a much broader buyer pool.

What changes for a seller

Once converted, the home conveys with the land. There is no DMV title to sign, and the transaction looks like an ordinary Virginia real estate closing with a deed recorded at the circuit court.

You also generally cannot sell the home separately from the land any more without reversing the process.

How to check whether it was already done

Compare your tax bills: a converted home usually appears inside the real estate assessment and no longer generates a separate personal property bill for the structure.

Then confirm in the circuit court land records, and with DMV as to whether an active title still exists. Do both before you assume, sellers are wrong about this often.

Common questions

Is conversion required to sell a mobile home with land in Virginia?
No. You can sell land by deed and a titled home by DMV title in the same transaction. Conversion simply simplifies it and widens financing options for buyers.
Can conversion be reversed?
There are processes for separating a home from real property again, but they are not automatic. Ask a Virginia real estate attorney before assuming you can detach a converted home.
